2. Introduction
These Terms of Service (the "Terms") govern your use of the gyermekfenykep.hu platform (the "Service"). By creating an account, logging in, accessing a gallery via a QR code, or placing an order, you ("Parent" or "User") agree to these Terms.
3. Accounts and Access
- The Service is used in two ways: (a) via a personal QR code issued by the Operator for a specific child and shooting session; (b) via a parent account created during the QR claim flow or through a separate registration with an optional invitation code.
- When you first use a QR code you will be asked to set a password and create an account linked to that QR code.
- You are responsible for keeping your credentials and QR code confidential and for all activity performed under your account.
- Accounts are intended for private individuals (parents or legal guardians). Companies cannot register an account, but an order placed by a parent can be invoiced to a company on request (see section 5).
4. Gallery Access via QR
- Each QR code grants access to exactly one child profile for one institution session.
- QR access does not expire automatically: the gallery and the QR link remain available.
- The Operator may revoke or regenerate a QR code at any time; old codes will stop working when this happens.
5. Orders and Payment
- A minimum order amount may apply (15,000 HUF by default). It can differ per institution and may be updated by the Operator; the minimum in force is always shown in the cart.
- There is no ordering deadline: your gallery stays available and orders can be placed at any time.
- Placing an order, accepting these Terms (via the checkbox on the checkout page) and clicking the pay button constitute a binding purchase offer from the User. The contract between the User and the Operator is concluded when the payment is successfully authorised by Barion.
- The confirmation and the electronic invoice are sent to the e-mail address provided at checkout.
- Invoices can be issued either to a private individual or to a company. For company billing you must provide the company name and a valid Hungarian tax number at checkout.
- The Operator is VAT-exempt (Hungarian "alanyi adómentes"), and therefore issues invoices that contain no VAT, for private and company customers alike.
5.1 Payment method – Barion
- Online card payments on the Service are processed by Barion Payment Zrt. (registered seat: 1117 Budapest, Infopark sétány 1., Hungary; licensed e-money institution, licence number: H-EN-I-1064/2013) via the Barion Smart Gateway.
- Accepted card schemes: Visa, Visa Electron, Mastercard, Maestro, Apple Pay (on supported devices). Payment is possible with or without a Barion wallet.
- The Operator does not store or process your card number or CVC. The card data is entered directly in Barion’s PCI-DSS certified environment over an encrypted connection.
- By clicking the pay button you accept the terms and privacy policy of Barion Payment Zrt. available at https://www.barion.com/hu/jogi-nyilatkozat-2/.
- Refunds (if applicable) are initiated by the Operator through Barion and are credited back to the original card.
5.2 Fulfilment
- Digital products: delivered electronically via the order page in the Service. Typical fulfilment time is the same day the payment arrives.
- Physical products (prints, photo products): typical production time is approximately 2 weeks from payment; the finished items are handed over at the institution. The exact pickup time and location are communicated separately by the Operator or the institution.
- Any significant deviation from the above fulfilment time will be communicated to the User in advance by e-mail.
6. Acceptable Use
You agree not to:
- share your QR code, login credentials or download links with third parties;
- download, copy, publish or redistribute photos beyond personal family use;
- attempt to bypass authentication, rate limits or other technical protections;
- upload content to the Service.
7. Intellectual Property
All photos remain the intellectual property of the photographer. Purchasing digital or physical products grants you a personal, non-exclusive, non-transferable license to use the photos for private, non-commercial purposes. Public publication (including on social media as commercial content), resale or commercial use requires prior written permission.
8. Consumer Rights and Withdrawal
As the products are personalised (custom-retouched or printed for a specific child), the statutory right of withdrawal under 45/2014. (II. 26.) Korm. rendelet §29(1)(c) does not apply once production has started. Complaints about defective products can be submitted to the Operator within a reasonable period.
9. Liability
- The Service is provided "as is". The Operator does not guarantee uninterrupted availability.
- The Operator is not liable for losses caused by a leaked QR code, password or download link if this was caused by the User.
- Nothing in these Terms limits liability that cannot be limited under Hungarian law.
10. Data Protection
Personal data is processed in accordance with the Privacy Policy available at /privacy, which forms an integral part of these Terms.
11. Changes
The Operator may update these Terms. New versions are published in the Service and you will be asked to accept the new version on your next login, registration or QR entry. Continuing to use the Service after a new version is published means acceptance.
12. Governing Law
These Terms are governed by the laws of Hungary. Disputes shall be settled by the courts of Hungary.
